There is so much misinformation on Texas Senate Bill 8, the Heartbeat Act, that I feel compelled to explain its provisions and defend its logic. I am the author of the bill, which was signed by Governor Greg Abbott in May.
The law does not prohibit abortion after six weeks. For this, it is necessary that the doctor performing the abortion first checks the heartbeat of the fetus. If there is heart palpitations, the doctor may not abort the baby. When a doctor performs an abortion without examining a heartbeat, or finds a heartbeat and performs an abortion anyway, she has performed an illegal abortion.
